Routine chemicals are included in the monthly invoice, subject to the following limitations:

Saltwater pools: The monthly service includes up to one (1) standard bag of pool salt per calendar month. Additional salt required during the month will be charged separately.

Chlorine pools: Routine chlorine and chemical treatment is included only to the extent permitted under applicable law and within the quantities Big Joe's Pools is legally permitted to use and provide.

Excessive chemical demand caused by algae, heavy pool usage, weather, contamination, improper customer chemical additions, equipment problems, water chemistry issues, or other abnormal conditions may require additional chemicals or treatment. Any additional chargeable treatment will be communicated to the customer when reasonably practicable.

Big Joe's Pools does not guarantee a particular chemical reading or water condition when factors outside of its control affect the pool.

Routine pool filter cleaning is included in the monthly service price.

Replacement filters, cartridges, grids, filter parts, damaged equipment, repairs, or other materials are not included unless specifically stated otherwise.

PHOSPHATE TREATMENT -

Routine phosphate testing/checking is included in the standard service.

Phosphate removal/treatment is not included in the regular monthly service price and will be charged separately.

Big Joe's Pools will notify the customer when phosphate treatment is recommended and, when reasonably practicable, obtain authorization before performing the additional treatment.

EXISTING CONDITIONS AND EQUIPMENT -

Big Joe's Pools is not responsible for pre-existing conditions, concealed defects, deterioration, improper installation, age-related failures, manufacturer defects, leaks, plumbing problems, electrical problems, structural problems, or failure of existing pool equipment.

Routine inspection or operation of pool equipment does not constitute a warranty or guarantee that the equipment is functioning properly or will continue to function properly.

If Big Joe's Pools discovers a problem with the pool or equipment, the customer will be notified when reasonably practicable.

WATER QUALITY AND POOL CONDITION -

Big Joe's Pools will use reasonable care and professional judgment to maintain the pool according to the customer's service plan.

However, Big Joe's Pools does not guarantee crystal-clear water, a particular water appearance, a particular chemical reading, or the prevention of algae, stains, scaling, or other water-quality problems.

Pool conditions can be affected by factors outside of Big Joe's Pools' control, including:

  • Weather

  • Rain

  • Storms

  • Heat

  • Heavy pool usage

  • Landscaping

  • Animals

  • Debris

  • Water source

  • Equipment malfunction

  • Leaks

  • Customer-added chemicals

  • Power outages

  • Improper use of the pool

  • Other environmental or property conditions

If abnormal conditions require additional treatment, chemicals, labor, or visits, those services may be charged separately.

CUSTOMER ACCESS AND PROPERTY CONDITIONS -

The customer must ensure that:

  • Gates are accessible.

  • Necessary access codes, keys, or instructions are provided.

  • Pets are secured.

  • The pool area is reasonably accessible.

  • Known hazards are disclosed.

  • Pool equipment is accessible when necessary.

If Big Joe's Pools arrives for a scheduled service and cannot safely or reasonably access the pool because of a locked gate, unsecured animal, inaccessible equipment, unsafe condition, or other customer-controlled issue, Big Joe's Pools may be unable to perform the service.

A service charge may still apply when the technician arrives but is unable to perform service because of a customer-controlled access or property issue.

CUSTOMER RESPONSIBILITIES -

The customer is responsible for notifying Big Joe's Pools of any known:

  • Leaks

  • Equipment problems

  • Electrical issues

  • Plumbing problems

  • Structural problems

  • Unusual water conditions

  • Recent chemical additions

  • Changes to pool equipment

  • Changes affecting property access

Customers should not make significant chemical additions between service visits without notifying Big Joe's Pools, as customer-added chemicals can affect water chemistry and the effectiveness of subsequent treatment.

WEATHER AND UNSAFE CONDITIONS -

Big Joe's Pools may delay, reschedule, shorten, or cancel a service visit when weather or conditions make service unsafe or impractical.

This includes, but is not limited to:

  • Lightning

  • Severe thunderstorms

  • Hurricanes

  • Flooding

  • Dangerous wind

  • Unsafe property conditions

  • Other circumstances outside Big Joe's Pools' reasonable control

Big Joe's Pools will make reasonable efforts to reschedule or resume service when conditions permit.

A weather-related delay or rescheduling does not automatically create an entitlement to a refund or credit.

MONTHLY BILLING AND PAYMENT -

Recurring monthly service is billed in advance on the first (1st) day of each month, unless otherwise agreed to in writing.

The customer's monthly service price covers the agreed recurring service for that month and is not calculated based solely on the number of individual visits performed during the month.

Payment is due on the 1st of each month.

The customer is responsible for ensuring that the payment method on file remains valid and available.

LATE PAYMENTS -

Accounts with unpaid balances after the due date may be subject to a late fee of $10 as permitted by applicable law.

Big Joe's Pools reserves the right to suspend service for accounts that remain unpaid.

Any costs associated with returned payments, failed payments, or other payment-processing issues may also be charged to the customer to the extent permitted by law.

SUSPENSION OF SERVICE -

Big Joe's Pools may suspend service if:

  • An account becomes delinquent.

  • Payment repeatedly fails.

  • The property presents an unsafe working condition.

  • Required access is repeatedly unavailable.

  • A customer engages in threatening, abusive, or inappropriate conduct.

  • The pool or equipment presents a condition that prevents safe service.

Service may resume once the issue has been resolved and any outstanding balance or applicable charges have been paid.

CANCELLATION -

Customers may cancel a scheduled service visit by providing at least twenty-four (24) hours' notice.

Big Joe's Pools may establish a reasonable cancellation fee for late cancellations, subject to applicable law and any separately agreed service terms.

For termination of recurring monthly service, the customer must provide written notice according to the cancellation terms communicated at the time of enrollment.

All outstanding balances for services already provided remain due after cancellation.

PHOTOGRAPHS, VIDEOS AND SERVICE RECORDS -

Big Joe's Pools may photograph and video record the pool, equipment, water condition, and relevant property conditions for service documentation, quality control, customer communication, and recordkeeping.

Photographs and videos may be used to document the condition of the pool before or after service, equipment conditions, maintenance performed, or issues requiring customer attention.

Big Joe's Pools will NOT intentionally photograph or video people, or peoples privacy.

LIMITATION OF LIABILITY -

Big Joe's Pools will perform services with reasonable care and professional judgment.

However, to the fullest extent permitted by applicable law, Big Joe's Pools shall not be responsible for indirect, incidental, special, consequential, or punitive damages arising from conditions outside its reasonable control, including pre-existing conditions, concealed defects, equipment failure, leaks, plumbing or electrical problems, structural defects, weather events, power outages, customer actions, or failures of existing pool equipment.

Nothing in these Terms is intended to waive or limit liability that cannot legally be waived or limited under applicable law.

NO WARRANTY OF EXISTING EQUIPMENT -

Big Joe's Pools does not provide a warranty for customer-owned pumps, filters, heaters, salt systems, chlorinators, automation systems, valves, plumbing, electrical components, pool surfaces, or other existing equipment unless a separate written warranty is expressly provided.

Routine inspection or maintenance does not create a warranty for any existing equipment.

SERVICE INTERRUPTION -

If a pool cannot be safely or reasonably serviced because of equipment failure, lack of water, unsafe conditions, contamination, severe weather, property access issues, or another condition outside Big Joe's Pools' reasonable control, Big Joe's Pools may suspend or modify service until the condition is corrected.

Additional service required to restore the pool to a normal serviceable condition may be billed separately.

CHANGES TO PRICING OR SERVICE -

Big Joe's Pools may modify recurring service pricing or service terms by providing reasonable advance notice to the customer.

Any additional service requested by the customer or required outside the agreed service plan may be billed separately.

CUSTOMER AUTHORIZATION AND ACCEPTANCE -

By signing a service agreement, approving a service proposal, accepting service, paying an invoice, or continuing to receive services from Big Joe's Pools, the customer acknowledges that they have had an opportunity to review and agree to these Terms & Conditions.
